First Degree Criminal Sexual Conduct: What You Need to Know
If you are accused of first degree criminal sexual conduct (CSC) in Michigan, you are facing a very serious charge that could result in a life sentence. First degree CSC involves sexual penetration with another person under certain circumstances, such as:
- The other person is under 13 years old
- The other person is between 13 and 16 years old and related to you by blood or affinity, lives in your household, or is under your authority
- The sexual penetration occurs during the commission of another felony
- The sexual penetration is aided or abetted by one or more persons and force or coercion is used
- You are armed with a weapon or an object that looks like a weapon
- You cause personal injury to the other person and force or coercion is used
First degree CSC is a felony that carries a maximum penalty of life imprisonment. If the victim is under 13 years old, there is a mandatory minimum sentence of 25 years. You will also have to register as a sex offender for life and be subject to electronic monitoring.
If you are charged with first degree CSC, you need an experienced and aggressive defense attorney who can fight for your rights and challenge the evidence against you. There may be defenses available depending on the facts of your case, such as consent, mistake of age, alibi, false accusation, or lack of proof.
